Yes, sure it *can* be hacked differently for this single case (but raising a different set of problems).

But I think it is not the right way to go. IMHO kernel is there for powering on/off all resources if there is no active client. Including this GPS chip.

And I don't want to require users to use initramfs if everything else works without. Just because of this chip (tail wakes the dog). 

This does no exclude to use initramfs for other reasons and avoids compatibility problems with different initramfs setups someone might want to use/develop.
